ESSENTIAL RIGHTS PROVIDED FOR IN DECREE-LAW No. 17/2018 OF MARCH 8

Essential information about the planned trip will be communicated to the traveler prior to the conclusion of the respective contract.

There is always at least one operator responsible for carrying out all the services provided for, covered in the contract.

An emergency telephone number will be provided to travelers so that they can communicate with the organizer or travel agency at any time.

Travelers may transfer the organized trip to third parties, subject to reasonable notice and possible payment of additional costs.

The value of the trip in question can only be increased in situations where there is an increase in specific costs (such as the price of fuel), if this possibility is explicitly provided for in the contract and, always, up to 20 days before the start date of the trip. If the price increase exceeds 8% of the price of the planned trip, the traveler may terminate the contract. If the organizer reserves the right to increase the price, the traveler will be entitled to a decrease in the price, in the event of a reduction in the relevant costs.

Travelers may terminate the contract without having to pay a termination fee and obtain a full refund of payments made in the event of a significant change in any of the essential elements of the organized trip, with the exception of the price. If, before the start of the trip to be undertaken, the operator cancels it, travelers are entitled to a refund and, possibly, even compensation.

Travelers may terminate the contract without having to pay a termination fee before the start of the travel date, in exceptional circumstances, such as in case of serious security problems at the destination, which could affect the trip in question.

Travelers may terminate the contract at any time prior to the commencement of the planned travel date, upon payment of an appropriate and justifiable termination fee.

If, after the start of the trip, the fulfillment of significant parts of the trip is not possible, as agreed, suitable alternative proposals will have to be presented to the traveler at no extra cost. The traveler can terminate the travel contract without paying a termination fee, if the services are not performed in accordance with the contract, and if this lack of compliance considerably affects the execution of the trip and the organizer does not make up for this lack.

Travelers are entitled to a price reduction and/or compensation for damages in the event of non-compliance or poor performance of travel services.

The organizer has to provide assistance when a traveler is in difficulty. If the organizer or the retailer is declared insolvent, payments will be refunded.

If the organizer or the retailer is declared insolvent after the start of the planned trip and if transport is included in the trip, the repatriation of travelers is guaranteed. Wild Douro Lda subscribed a protection in case of insolvency with the Travel and Tourism Guarantee Fund. Travelers may contact this entity or, if applicable, the competent authority (Turismo de Portugal, IP, Rua Ivone Silva, Lote 6, 1050-124 Lisboa, Tel. 211 140 200(Calling the National Fixed Network) | Fax. 211 140 830, info@turismodeportugal.pt ) if the provision of services is refused due to the insolvency of Wild Douro Lda.

COMMUNICATION/DECLARATION OF ACCEPTANCE

1. LEGAL DATA PROCESSING

Wild Douro will collect, store and process the traveler’s data in order to comply with legal obligations, to comply with this contract and also because the traveler gives his consent.

2. RESPONSIBLE FOR THE TREATMENT

The Management of Wild Douro identified in this contract will be responsible for processing the traveler’s data, whose data processing will be internal, and Wild Douro is expressly authorized to, if it so chooses, carry out this processing externally.

3. DATA COLLECTION

The data will be provided by the traveler and they will be their responsibility.

4. PURPOSES OF DATA PROCESSING

Wild Douro will process data for the following purposes:

4.1. ACCOUNTING, TAX AND ADMINISTRATIVE MANAGEMENT

Economic and accounting management, tax management, administrative management, invoicing management, customer management, collection and payment management, supplier management and history of commercial relationships. 5. PERSONAL DATA CONTAINED IN THE REGISTRATION

They include name, address, telephone and email addresses, date of birth, gender, nationality and passport

6. COMMUNICATION OF DATA TO THIRD PARTIES

Wild Douro may communicate or transfer, in part or in full, the traveler’s personal data to public and/or private entities, whenever this arises from a legal obligation and or is necessary to comply with this or other contracts, being expressly authorized to do so. by the traveler.

7. DATA STORAGE PERIOD

Wild Douro will keep the traveler’s data for the necessary period, in order to comply with legal obligations, namely 10 (ten) years to comply with the legal obligation to file all commercial written documentation.

8. DATA HOLDER RIGHTS

The traveler may request Wild Douro and the latter, unless legally prevented, will safeguard the traveler’s rights of access to personal data concerning him, as well as its rectification or exclusion, the limitation of the treatment and the right to oppose the processing, as well as the right to data portability. The right to withdraw consent at any time is also provided for, without compromising the lawfulness of the processing carried out based on compliance with legal obligations or on the basis of the consent previously given. The right to complain about the processing of data to the National Data Protection Commission is also contemplated.

9. DATA PROCESSING SECURITY

Taking into account the most advanced techniques, the application costs and the nature, scope, context and purposes of the treatment, as well as the risks of variable probability and gravity for the rights and freedoms of individuals, Wild Douro applies the appropriate technical and organizational measures to ensure a level of security appropriate to the risk, as appropriate.

10. PERSONAL DATA BREACH

In case of breach of personal data, Wild Douro notifies this fact to the National Data Protection Commission under the terms and conditions provided by law. If such violation is likely to imply a high risk to the rights and freedoms of the holder, inform him of this fact, under the terms and conditions provided for by law.
